Dear Mrs Oliver,

I am writing in response to your request for information (ref FOI 7834) regarding Additional requests re Bredbury fire. We apologise for the delay in replying to your request.

Further to your 6 emails of 19/09/13 from 11.38 am – 11.52 and your 2 emails 07/10/13 from 17.08 pm – 18.02 pm, the council has collated those requests into one response.

The information prepared by the relevant Council service is as follows:

· The requested information is available to view on the scanned application files. This can be viewed by contacting 0161 474 4810 to arrange an appointment to view the electronic application files.

Request 1 -

Dear FoI Officer

Regarding this below, why were there no site notice or press notice dates? Site notice was posted on site and dated 26/3/10. Press noticefrom Stockport Express 3/3/10. Both available to view on the document viewer under reference DC043683.

Request 2 -

"2) Prior to the approved materials recycling facility being brought into use, a 'Statement of Operation' which outlines:

(a) how the site will operate;

(b) the maximum volume of waste that will be processed;

(c) the vehicle movements associated with this operation;

and which shall be based on the information submitted in support of the application, shall be submitted to the local planning authority for written approval. The approved materials recycling facility shall then operate in accordance with the approved 'Statement of Operation' at all times (or such other statement that may be agreed in writing by the local planning authority). The volume of waste processed at the facility shall not exceed that outlined in the Statement of Operation unless otherwise agreed in writing by the local planning authority."

May I see the Statement of Operation please. Condition 2 (statement of operation) – approved 27/08/10. Statement is available to view on the document viewer under reference DC043683 (attached to email from Andrew Barton of Axis is attached to his email of 20th August 2010).

Request 3 -

"15) No development shall take place until a method statement detailing how the development will be constructed has been submitted to and approved in writing by the local planning authority. The method statement shall include details on traffic management and control measures, parking arrangements, details of deliveries and details of how and where materials will be loaded, unloaded and stored. Development of the site shall not proceed except in accordance with the approved method statement."

May I see this statement please. Condition 15 (traffic management statement) – available to view on document viewer.

Request 4 -

17) No development shall take place until a drawing outlining any areas within the site that will be used for the storage of materials or other items has been submitted to and approved in writing by the local planning authority. Any materials / items to be stored within the site shall only be stored within these areas.

May I see this please. Condition 17 (storage of materials) – approved 23/7/10. Drawing number 5337-P4-001 Rev 8 is available to view on the document viewer under reference DC043683.

19) No part of the development shall be occupied until all works necessary to prevent landfill gas migration into the development have been approved in writing by the local planning authority and carried out in full. Following completion of measures identified in the approved remediation scheme, a verification report (referred to in PPS23 as a validation report) that demonstrates the effectiveness of the remediation carried out must be produced, and is subject to the approval in writing of the local planning authority.

May I see this please? Condition 19 (measure to prevent migration of landfill gas and verification report) – approved 17/2/12. The report (Gas Risk Assessment - September 2009 – Geo Assist) is available to view on the document viewer under reference DC041362 (as the completed development is a hybrid of 2 schemes approved under reference DC041362 and DC043683).

Environmental assessment not required

Dear FoI Officer

What was the name of the official who decided no environmental assessment was needed?Council Officers are not aware of any environmental assessment having been carried out.

Any refusal to respond will be forwarded to McDonald's lawyers.
